I, Jacob Wallace, do hereby swear to the following. ON May 6, 2021, I brought my 2004 Chevy Silverado, Lic # 73846B3, to Hal’s Tire & Complete Auto Care, Inc. for complete auto care. Odometer reading was 140,722 miles. I informed this business that I was doing a two month cross country road trip and wanted all aspects of the truck checked, repaired and documented. I was billed $ 2,676.33, paid in cash.

After being on the road, I became aware that the brake sensor had not been repaired by Hal’s Tire & Total Car Care, Inc. The differential (rear axle gear) had gone out in Alabama. Tire City and Automotive Service, Montgomery, Al., reported that the gear axle oil was low and that that resulted in the unit's failure. Odometer reading was 145,545 miles or 4,823 miles after Hal’s Tire & Total Car Care That bill was $3,894.05, paid in cash.

On July 15th, I engaged Hamid Rastavan and Hunter Rastavan seeking a resolution. I offered that Hal’s Tire & Total Car Care, Inc. could split the differential bill 50/50. The business refused. However, Hamid Rastavan, “resolution” was that the business would repair the brake sensor if I signed a declaration that the business was not accountable for the differential repair. Hamid Rastavan, boasted about going to court or filing a Bureau of Auto Repair complaint, would be a waste of time.

On July 17th, 2021, the truck was brought to the Midas Touch, Vista, CA shop for a possible brake sensor repair and inspection. That shop reported and documented that the rear brake pads are at 20% and could not have been new 8+k miles ago, the mileage was 148,800.

I demand that Hal’s Tire and Total Car Care, Inc. pay for the differential repair and the brake sensor work for a total of approximately, $ 4,394.05 ($3,894.05 + $500).
If there is no response in 10-business days, Hal’s Tire & Total Car Care, inc. will be sued in a court of law. Hunter Rastavan will be subpoenaed as a material witness.

After filing a BBB complaint, Hal claimed that they use the Mitchell System, when Hunter stated they failed to get a Carfax. Hal could not produce the Michel System docs showing it was yet another untruth. The customer MUST according to Hal clearly identify any problem bc their ACE ,mechanics are able to. The business has a revolving narrative. Hal became unhinged and threatening in the work place threatening to call the police, something he does when customers challange him

Unprofessional/No Warranty/No Carfax/Coerced Resolution
In early May 2021, I brought a 2004 Chevy Silverado (4.8- 141K) in for "complete" servicing. I told Hunter, Hal & Alberto-the mechanic, I was doing a two month, 7k+ cross country camping trip and needed all to work. Cost was not an issue.

In hindsight, and first off, they never generated a Carfax. This was a significant transgression bc w/o that history of prior service they had no idea of the truck's condition. even though the transmission oil was over due and it needed a complete brake job to include a hub that was blown out, two heater hoses were leaking. Second, the final invoice has NO information in the comment section, this is unusual as shops will always cite any possible maintenance issue or scheduled maintenance not addressed as a CYA, but not Hal's. Hunter said they were busy that day and failed to document that information. Hmmmm.

I also reported initially that the break "wobbled" in the final seconds of braking (which turned out to be a brake sensor-that issue was not repaired after Hal's completed the work. That total bill cost, $2,676.33.

Sadly, it gets much worse!

With all the "red flags", Alberto never accessed the differential oil which was as simple as unscrewing a thick bolt and dipping a finger in. This failure cost me dearly when the differential went out in Montgomery, Alabama in the tune of $3,600 for a rebuilt one & one year warranty. This included a tow charge and hotel costs as the truck was on the rack in Bama for 7-days.

I arranged for Hal to speak to the shop in Alabama. Hal, diluted and misrepresented that shop's position on the differential. Hal produced bizarre speculative scenarios to explain that issue. For example, it probably started leaking after the truck left the shop.

It is $150 to service the differential at Hal's.

When I returned to Hal's over the past three days-July 12+, Hal said he would fix this issue bc I was polite and had written a previous positive review. Hal said that he'd ignore most customers. Hal engaged in a circular, redundant, illogical discussion, raising his voice and pointing fingers, always attempting to distance the shop from his 12-month written warranty. The excuses ranged from, Alberto is in Mexico, I can't call him, I was responsible and "do you think we can check everything"!

Hal's "resolution" was that if I signed a declaration not making him responsible for the differential, that he knew he was liable for they would fix the brake sensor-that they failed to repair earlier. Remarkable, Hal inflated that repair to make the offer better and offered some "free" oil changes. I offered Hal to share the $3,600 cost @ $1,800 , which Hal claimed would have been their cost. But Hal had no interest in taking any responsibility.
In fact, Hal boasted that filing a small claims case or reporting to the Bureau of Auto Repair, would be fruitless. We shall see.

It appears that Alberto was fired though the cover story is that he went back to Mexico and could not be reached. While speculative, after spending countless hours in the shop on the initial "service" and slips that Hal made about Alberto over the past three days. One could deduce that Alberto sabotaged the job on purpose, and possible many others to boot. Hal's disdain for Alberto was just under the surface.

The shop's lack of due diligence, failure to implement simple and obvious checks and repairs, refusal to uphold their 12-month warranty, coupled with unprofessional conduct, clearly shows that this shop is a black hole.

P.S. On the first day, July 12th, a customer was returning a Honda that was previously serviced bc the identical "repaired" issues were now reoccurring.
